On December 24, 2020, on the occasion of the 16th anniversary of the founding of the Research Center for Forensic Expertise in the Field of Intellectual Property of the Ministry of Justice of Ukraine (hereinafter referred to as the Center), and with the aim of studying and developing the scientific heritage of the Center’s first director, Petro Pavlovych Krainiev (1952–2014), the Center successfully held the IV Annual International Scientific and Practical Conference “Problems of Theory and Practice of Forensic Expertise in the Field of Intellectual Property” (“Krainiev Readings”). The event was attended by representatives of the Ministry of Justice of Ukraine, other state authorities, research forensic institutions, judges, lawyers, pre-trial investigation bodies, patent attorneys, law firms, enterprises, organizations, and other colleagues and partners of the Center.
First Deputy Chairman of the Verkhovna Rada of Ukraine, Doctor of Law, Professor, and Academician of the National Academy of Legal Sciences of Ukraine, R.O. Stefanchuk, delivered a welcoming address to the participants of the IV “Krainiev Readings”. He emphasized the important mission of the Center in the modernized system of protection of intellectual property rights in Ukraine and wished the Center’s team further effective development and successful performance in forensic expertise, scientific, and methodological activities.
Deputy Minister of Justice of Ukraine for Enforcement Service A.V. Haichenko noted in his greeting that the Center has established itself as an independent, necessary, and important research forensic institution for Ukrainian society and the state, and wished the management, forensic experts, and researchers of the Center to continue striving for new professional achievements.
Judge of the Supreme Court, Doctor of Law, Professor Ya.O. Bernazyuk congratulated the Center on its anniversary and emphasized that the Center’s management and team have proven themselves as a true hub for conducting forensic examinations and expert research in the field of intellectual property. Although the Supreme Court is not a direct customer of such examinations, they are extremely important for courts of first instance, as the quality and objectivity of these examinations determine the outcomes of disputes over intellectual property rights.
On behalf of the National Bureau of Expertise of the Republic of Armenia, a partner of the Center, Deputy Director for Scientific Affairs P.S. Voskanyan extended congratulations, along with his colleagues A.A. Harutyunyan and Sh.A. Movsisyan, who had undergone internship at the Center the previous year.
Director of the Department for Expert Support of Justice of the Ministry of Justice of Ukraine N.M. Tkachenko and Director of the Directorate for Justice and Criminal Justice O.M. Oliinyk also delivered welcoming remarks.
Further, the following issues were submitted for consideration by the participants of the “Krainiev Readings”:
- Theory, history, and methodology of forensic expertise in the field of intellectual property in Ukraine and abroad.
- Scientific heritage of the founder of the Research Center for Forensic Expertise in the Field of Intellectual Property, forensic expert and scholar P.P. Krainiev (1952–2014).
- Forensic expertise in the field of copyright and related rights.
- Forensic expertise in the field of technical creativity and means of individualization — commercial (company) names and trademarks, etc.
- Economic research and expertise in the field of intellectual property.
- Expertise of computer programs, databases, and telecommunications during the resolution of expert tasks in the field of intellectual property.
- Prospects and ways of development and improvement of science and education in the field of intellectual property protection.
In the main part of the event, the following thematic reports were presented:
- Vladyslav Leonidovych Fedorenko, Director of the Research Center for Forensic Expertise in the Field of Intellectual Property of the Ministry of Justice of Ukraine, Doctor of Law, Professor, Honored Lawyer of Ukraine, forensic expert — “Strategic Priorities for the Development of the Research Center for Forensic Expertise in the Field of Intellectual Property of the Ministry of Justice of Ukraine”.
- Anton Mykolayovych Koval, Partner at the Dubinsky & Osharova Patent and Law Agency, lawyer, patent attorney — “Current Issues of Trademark Protection”.
- Alla Petrivna Kopytko, Senior Researcher at the National Scientific Center “Institute of Forensic Expertise named after Honored Professor M.S. Bokarius” — “Medicines Registered as Trademarks”.
- Viktoriya Yuriivna Sopilnyak, Partner at the Dubinsky & Osharova Patent and Law Agency, lawyer, patent attorney — “Expert vs Consumer: Who Wins?”.
- Halyna Yevhenivna Kryvonozhko, Head of the Information Technology Sector of the Laboratory of Copyright and Information Technologies of the Center, Candidate of Technical Sciences, Senior Researcher, forensic expert — “Main Aspects of Solving Tasks in Conducting Forensic Examinations (Expert Studies) on Calculating Labor Costs for Software Development Based on the COCOMO II Model”.
- Nataliia Valeriyivna Kisil, Head of the “Expert&Technology” Bureau, Candidate of Agricultural Sciences, Senior Researcher, forensic expert in the field of intellectual property — “Training of Forensic Experts: Modern Approaches and Opportunities to Increase Efficiency”.
At the conclusion of the IV “Krainiev Readings”, the following were presented:
- the updated official website of the Center;
- the Collection of Materials of the IV International Scientific and Practical Conference “Krainiev Readings”;
- the special issue of the scientific electronic journal “Expert: Paradigms of Legal Sciences and Public Administration”, 2020, No. 6(12);
- the scientific and methodological publication “Forensic Expertise of Intellectual Property Objects”, 2020 (2nd edition).
Summarizing the results of the conference, the moderator and Director of the Center V.L. Fedorenko thanked all participants and proposed key provisions for the resolution of the IV “Krainiev Readings”.
